                   	     ORDINANCE NO. 10593
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING AN UNNAMED
                   STREET LOCATED NORTHEAST FROM HIGHWAY 153,
                   NORTHEAST OF GRUBB ROAD, MORE PARTICULARLY
                   DESCRIBED HEREIN, UPON CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned an unnamed street located northeast from Highway
         153, northeast of Grubb Road, more particularly described 
herein,
         and as shown on plat attached hereto and made a part hereof by
         reference:
                A 40 foot wide unnamed and unopened right-of-way
                beginning on the southeast line of Highway 153
                1052.3 feet northeast of the intersection of the
                southeast line of Highway 153 with the northeast
                line of Grubb Road, thence northeast some 730.58
                feet, thence northwest 40 feet, thence southwest
                some 664.4 feet to the southeast line of Highway
                153, thence southwest some 40 feet with Highway 153
                to the point of beginning.  Said street separates
                lots 1-3 and part of 4, Subdivision of Jesse Evans
                Tract, as shown by plat of record in deed book 806,
                page 302, ROHC, from lots 6 and 8, said Jesse Evans
                subdivision, and lot 1, Winston Knowles
                Subdivision, as shown by plat of record in plat
                book 38, page 205, ROHC.  Tax Map No. 91P-B-13-19.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:

                1. The Electric Power Board of Chattanooga has
                   distribution facilities located within said
                   right-of-way which must be maintained for the
                   use and benefit of its customers and an easement
                   the width of the entire right-of-way is reserved
                   for the operation, maintenance, rebuilding, and
                   replacement of these distribution facilities.
               
                2. The areas reserved for utility easements must be
                   kept free and clear of all structures.
               
                3. All existing easements are retained.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
